U.S. District Court Judge R. Brooke Jackson has ruled that some of the claims filed by victims and relatives of the Aurora movie theater shooting in Colorado last summer may proceed. However, other claims for negligence against theater owner Cinemark USA are not valid. In his ruling, Judge Jackson found that Cinemark can be sued for premises liability and potentially wrongful death, but that the plaintiffs cannot sue for negligence because of the state’s Premises Liability Act. This act does not allow plaintiffs to allege both negligence and premises liability when the injury in both claims is caused by and on an owner’s property.
